| China Issues Record Number Of Patents In 2009 |

China issued a record number of patents in 2009, the country's State Intellectual
Property Office (SIPO) has announced.
According to SIPO, more than 580,000 patents were issued last year, a 41% increase
on 2008. In total, the office received 977,000 patent applications in 2009,
an 18% increase in comparison to the previous year.
The number of Patent Cooperation Treaty applications from other countries also
rose, reaching 8,000 and putting China into the top five in the world in this
respect.
The increase in patent applications and grants has coincided with a revision
to China's patent laws and efforts by the government to convince the world that
it is serious about tightening up its hitherto loosely-policed intellectual
property enforcement regime.
The patent reform, which entered into force on October 1 last year, was the
third since China's patent law was first introduced 25 years ago. A substantial
number of provisions have been amended, and completely new articles added. Implementation
guidelines were issued on February 1 this year.
The changes focus on two broad areas: firstly, they aim to ensure better protection
for the intellectual property rights of patent holders, encourage innovation
and speed up the introduction of patented technology; and secondly they harmonize
Chinese patent law with international patent treaties.
The new law also introduces the concept of 'absolute novelty' for all patents
and designs registered in China. Previously, inventors only had to demonstrate
'local novelty' meaning that it was easy for inventions and designs developed
elsewhere to be copied and protected in China.
However, not everyone is convinced that the new patent law achieves Beijing's
objective of reducing the incidence of patent fraud and generally clarifying
the system for the benefit of foreign firms. Indeed, some experts argue that
the law allows the state to discriminate against foreign companies by favoring
domestic firms in the area of government procurement. The new rules also require
companies applying for patents in China to undergo lengthy security clearance
procedures before they can apply for foreign patents.
